Terms of Service - Trita Medical Clinic

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Trita Medical Clinic ("Trita," "we," "us," or "our") concerning your access to and use of the tritamedicalclinic.com website and any related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Services.

Trita provides:

• Family medicine and primary care services
• Cosmetic medicine and aesthetic treatments
• Preventive health and wellness programs
• Health consultations and assessments
• Patient portal and online booking
• Trita Portal patient management platform

Specific terms for individual services may be provided in separate agreements.

When you create an account (for Trita Portal or other services), you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

Our Content All content on the Site—including text, graphics, logos, images, videos, designs, and software—is the property of Trita or our licensors and is protected by copyright, trademark, and other intellectual property laws. Your Use You may view and download content for personal, non-commercial use only. You may not:

• Modify, copy, or distribute our content without permission
• Use our content for commercial purposes without a license
• Remove copyright or proprietary notices
• Create derivative works based on our content

Your Content By submitting content to our Site (project briefs, feedback, etc.), you grant us a non-exclusive license to use, modify, and display such content in connection with our Services.

Pour les services médicaux et cliniques : Consultations et rendez-vous

• Les rendez-vous peuvent être pris en ligne, par téléphone ou en personne
• Une carte santé de l'Ontario (RAMQ/OHIP) valide est requise pour les services assurés
• Les annulations nécessitent un préavis d'au moins 24 heures

Dossiers médicaux

• Les dossiers des patients sont conservés conformément à la législation ontarienne sur la vie privée (LPRPS)
• Les dossiers sont conservés pendant la période minimale requise par l'Ordre des médecins et chirurgiens de l'Ontario
• Les patients peuvent demander l'accès à leurs dossiers à tout moment

Services cosmétiques

• Des consultations cosmétiques sont offertes avant toute intervention élective
• Des plans de traitement détaillés et un consentement éclairé sont requis
• Les prix sont fournis lors de la consultation et peuvent varier selon les plans de traitement individuels

Pour le portail patient et les services en ligne : Accès au compte

• L'accès au portail patient nécessite une inscription et une vérification d'identité
• Vos identifiants de connexion sont personnels et ne doivent pas être partagés
• Vous êtes responsable de la confidentialité de votre compte

Services en ligne

• La prise de rendez-vous en ligne, les renouvellements d'ordonnances et la messagerie sont fournis pour votre commodité
• Ces outils ne remplacent pas les consultations médicales en personne lorsque cela est cliniquement nécessaire
• Les délais de réponse aux messages peuvent varier; pour les urgences, appelez la clinique ou composez le 911

Données et dossiers

• Les informations saisies dans le portail font partie de votre dossier médical
• Les données du portail sont stockées en toute sécurité conformément à la législation ontarienne sur la vie privée
• Vous pouvez demander l'exportation ou la suppression de vos données du portail à tout moment

General

• All prices are in Canadian Dollars (CAD) as indicated
• Taxes are additional unless otherwise stated
• Payment methods accepted are displayed during checkout

Refunds

• Consultation fees are non-refundable
• Project deposits are non-refundable once work commences
• Trita Portal subscriptions: Pro-rata refunds available within 14 days

Disclaimer of Warranties THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRITA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. Our total liability shall not exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Trita, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through the courts of Ottawa, Ontario, Canada.

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our Site. Continued use after changes constitutes acceptance.
