Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Trita Medical Clinic ("Trita," "we," "us," or "our") concerning your access to and use of the tritamedicalclinic.com website and any related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Services.

Services Description

Trita provides:
  • Family medicine and primary care services
  • Cosmetic medicine and aesthetic treatments
  • Preventive health and wellness programs
  • Health consultations and assessments
  • Patient portal and online booking
  • Trita Portal patient management platform
Specific terms for individual services may be provided in separate agreements.

User Accounts

When you create an account (for Trita Portal or other services), you agree to:
  • Provide accurate, current, and complete information
  • Maintain and promptly update your information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.

Intellectual Property

Our Content All content on the Site—including text, graphics, logos, images, videos, designs, and software—is the property of Trita or our licensors and is protected by copyright, trademark, and other intellectual property laws. Your Use You may view and download content for personal, non-commercial use only. You may not:
  • Modify, copy, or distribute our content without permission
  • Use our content for commercial purposes without a license
  • Remove copyright or proprietary notices
  • Create derivative works based on our content
Your Content By submitting content to our Site (project briefs, feedback, etc.), you grant us a non-exclusive license to use, modify, and display such content in connection with our Services.

Medical Services Terms

For medical and clinical services: Consultations and Appointments
  • Appointments can be booked online, by phone, or in person
  • A valid Ontario health card (OHIP) is required for insured services
  • Cancellations require at least 24 hours notice
Medical Records
  • Patient records are maintained in accordance with Ontario privacy legislation (PHIPA)
  • Records are retained for the minimum period required by the College of Physicians and Surgeons of Ontario
  • Patients may request access to their records at any time
Cosmetic Services
  • Cosmetic consultations are provided before any elective procedure
  • Detailed treatment plans and informed consent are required
  • Pricing is provided during consultation and may vary based on individual treatment plans

Patient Portal Terms

For patient portal and online services: Account Access
  • Access to the patient portal requires registration and identity verification
  • Your login credentials are personal and must not be shared
  • You are responsible for maintaining the confidentiality of your account
Online Services
  • Online booking, prescription renewals, and messaging are provided for convenience
  • These tools do not replace in-person medical consultations where clinically necessary
  • Response times for messages may vary; for urgent matters, call the clinic or dial 911
Data and Records
  • Information entered in the portal forms part of your medical record
  • Portal data is stored securely in compliance with Ontario privacy legislation
  • You may request export or deletion of your portal data at any time

Payment Terms

General
  • All prices are in Canadian Dollars (CAD) as indicated
  • Taxes are additional unless otherwise stated
  • Payment methods accepted are displayed during checkout
Refunds
  • Consultation fees are non-refundable
  • Project deposits are non-refundable once work commences
  • Trita Portal subscriptions: Pro-rata refunds available within 14 days

Disclaimers and Limitations

Disclaimer of Warranties THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRITA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. Our total liability shall not exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Trita, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:
  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through the courts of Ottawa, Ontario, Canada.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our Site. Continued use after changes constitutes acceptance.
